1. The general provisions
Mgr. Štěpánka Řezáčová ID No.: 04754221 (hereinafter referred to as the “accommodation provider”), hereby issues the following GENERAL TERMS AND CONDITIONS (hereinafter referred to as the “GTC”) in accordance with the provisions of Section 1751 of Act No. 89/2012 Coll., the Civil Code, as amended (hereinafter referred to as the “Civil Code”):
The subject matter of these GTC of the accommodation provider is to regulate the terms and conditions for the provision of accommodation and related services to the client (hereinafter referred to as the “client”). The GTC are an integral part of all arrangements between the accommodation provider and the client. By confirming the Accommodation Provider’s Offer or the Client’s reservation (hereinafter referred to as “Reservation”), the Client acknowledges the following GTC as binding for all services related to the subject matter of the GTC.
2. Payment conditions
A deposit of 50% of the room rate is required to confirm the reservation, within 5 days of booking. The balance of the agreed price must be paid on arrival. If the deposit is not duly paid by the client, the accommodation provider reserves the right to cancel the agreed reservation and to charge the client the corresponding cancellation fees according to point 5 of these GTC. The client is obliged to pay the deposit by transfer to the bank account of the accommodation provider. Prices are listed on the website and do not include the spa fee, which is 35,-CZK / night / adult.
3. Client rights and obligations
A confirmed reservation entitles the client to use the paid services. The client is obliged to check the accuracy of the data on this reservation. If any discrepancy is found, the client shall immediately contact the accommodation representative by telephone.
The client has the right to use the accommodation unit for the agreed period of time.
The client is obliged to treat the property of the accommodation provider with care. The client is obliged to immediately report any detected defects or damage to the equipment to the accommodation provider. The client is obliged to maintain order and cleanliness in the entire building and in all other areas of the accommodation facility. The client is obliged to observe the night time quiet from 22:00 to 6:00. The client is obliged to secure private (brought in) belongings so that they cannot be stolen. The accommodation provider does not insure these items and, due to the nature of the accommodation facility and operating conditions, is not liable for these items.
Upon arrival at the accommodation facility, the client is obliged to take the keys from the box at the entrance gate. If the keys are lost, the client is obliged to notify the accommodation provider without undue delay. The keys are the property of the accommodation provider, in case of loss the client is obliged to pay the expenses related to the replacement of the insert, keys, etc., or other costs that the accommodation provider will be forced to incur to eliminate the consequences caused by this loss.
The client shall be liable and responsible to the accommodation provider for any damage caused by him or his guest or other persons using the accommodation provider’s services with the knowledge or at the client’s will.
The Client is obliged to hand over the accommodation facility to the accommodation provider in the condition in which he/she took it over. In the event that the Client fails to hand over the accommodation facility (including accessories) to the accommodation provider in the condition in which he/she took it over, the accommodation provider is entitled to charge the Client a monetary penalty up to the amount of the costs associated with restoring the accommodation facility to its original condition.
The client is obliged to vacate the accommodation facility on the day of departure by 10:00 unless otherwise agreed with the accommodation provider. In the event that the client fails to vacate the accommodation facility at the specified time, the accommodation provider is entitled to charge the client for an additional day of stay or evict the client’s personal luggage and ensure that the rights of other clients are not restricted.
The client is forbidden to:
- allow third parties to enter, stay and sleep in the accommodation facility, lend keys to the accommodation facility to third parties,
- move furniture without the consent of the accommodation provider,
- smoking in the accommodation,
- bring into the accommodation facility and have in the space used: flammable, explosive and incendiary substances, weapons, drugs (including marijuana),
- bulky items, gas appliances, electric heating appliances, electric hot plates, etc,
- pollute or otherwise deface the premises and surroundings of the accommodation facility.
A condition for staying in the accommodation facility of the accommodation provider is in particular the observance of the basic rules of social coexistence, tolerance and mutual respect in the sense of the Civil Code, observance of the night peace, observance of order and cleanliness in all areas inside the building and in its immediate surroundings. For violation of the obligations specified in these General Terms and Conditions, the accommodation provider is entitled to charge the client a monetary fine of up to CZK 10,000.
The right to accommodation in the accommodation facility expires on the last day of accommodation specified in the accommodation order confirmation by the accommodation provider.
The right to accommodation shall cease immediately if the client violates these GTC or grossly violates the rules of social coexistence or if the client fails to pay the accommodation services to the accommodation provider as agreed. In such a case, the accommodation provider may terminate the accommodation services without any claim for reimbursement of the remaining amount for accommodation.
The right to accommodation in the accommodation facility expires on the last day of the period for which the accommodation services are paid. The client is obliged to leave the accommodation facility and hand it over to the accommodation provider, including all the details, by 10:00 a.m. Failure to comply with this obligation is subject to a fine of CZK 1,000. In case of termination of accommodation, the client is not entitled to an alternative accommodation.
4. Rights and obligations of the accommodation provider
The accommodation provider can extend the stay of the client only if the accommodation provider has available capacity.
If the client ends his/her stay earlier than agreed in the booking confirmation, the accommodation provider has the right to charge the client for the entire stay including services.
The landlord is entitled to terminate the services provided to the client and withdraw from the contract with immediate effect and without the client being entitled to a refund when:
- The client intentionally or negligently damages the property of the accommodation provider or his/her behaviour is contrary to the principles of decent social behaviour, morality or harasses third parties with his/her behaviour,
- the health condition of the client endangers the health of third parties and staff,
- due to force majeure.
The accommodation provider is entitled to use the personal data provided by the client in the order of stay only for the contractual relationship between the accommodation provider and the client.
5. Cancellation policy and non-arrival
If the client withdraws from the contract, he/she is obliged to pay the following cancellation fees from the total price of the stay.
Cancellation fees are:
- no cancellation fee for cancellation 30 days or more before the agreed arrival date
- 50% of the total price in case of cancellation 29-15 days before the agreed arrival date
- 100% of the total price in case of cancellation 14-0 days before the agreed arrival date.
Individual cancellation policy – in individual cases, the accommodation provider may suggest a different accommodation date. Individual cancellation conditions or rescheduling of accommodation can be individually adjusted between the accommodation provider and the client exclusively in writing.
If the client does not arrive on the booked accommodation date and does not cancel the reservation in writing, the reservation is cancelled and the client is charged 100% of the price of the stay.
These General Terms and Conditions come into force on 1 September 2023.
Changes and additions to these terms and conditions may be individually agreed between the accommodation provider and the client.
